    stay out. Only insane will do that.

    It is illegal
    - to bear any expenses while processing h1b/gc.
    - to accept job that is not there.

    Today is oct2nd. Dont forget gandhi. be a man and have righteousness in heart.

    So am still little confused... Should I go this route... The reason is the company who is willing to do my GC is doing also in good faith. But with the economy the way it shapes up... they are not sure, but as a good faith they did agree to start my GC process. Well I will be bearing the lawyer expenses...they would manage the mandatory fees. So they have very little to loose.

    What do you guys suggest! I have heard many people who work with company A and GC is done by Company B ... ( Correct me if I am wrong here)

    I changed jobs recently and retained my attorney from previous employer even though I had the option of using the current employer's attorney for free. The reason being

    1. I had good relationship with my previous attorney.
    2. I never know when my dates (EB-I 06/03) will be current and in case of a layoff or future job change, we need to update USCIS with the new attorney information which I thought will raise a few eyebrows and was not comfortable with this option.
    3. Even though you change attorney and send the updated details to USCIS, chances are that they don't update the system and any RFE or information may still get sent to the original attorney that filed your I-485.

    Note, that I am not suggesting you one way or the other, these are the reasons for making my decision, hopefully this will help you make an informed decision.

    I like your reasons.I have good realations with my employer.
    My attornety is through my company though I paid her.
    I'm still concerned with this 'what if my employer and through him my attorney do something that might harm my case if I move to another company'( as my old company will not have me and that will make their business a difference)
    And it's attorney who will have to let me know if there is any RFE in future.
    For the same fear I'm not even asking my attorney any AC21 related doubts that I have as she may go to my employer , tell him about it and that would be like giving him reason to believe I'm moving out even before I made any move.
    If I changed the attorney then there is other set of reasons to be concerned about.

    I would really appreciate it if any one could suggest something on this dilemma that I'm going through (having gone through this themselves or otherwise).

    1. New employer while filing for H1 Transfer will get 3 year
    2. You can start PERM when ever you like. Better to start early, just in case if Priority date becomes current, you can apply for 485

    Yes Interfiling is just for that, no matter how the labor cert was used, when that EB3 I140 was approved it was all valid. Now you are only porting the PD from that approved EB3 I140.

    If you are to file I485, have your attorney write up a letter explaining how you are eligible for filing I-485 based on interfiling your EB2 I-140. Also the letter need to be in bright colored sheet to differentiate from other B/W docs and application.

    Now a days USCIS automatically approves I-485 based on the earlier PD. Since in your case you don't have a I-485 you are not being benefited by it. I have read in IV that people getting GC based on their previous EB3 I-140 PD(with PD being current), if they happen to have another EB2 I-140.

    Thanks RaviENK. Let me put my exact case details here. I have EB3 I140 approved with my current employer with the priority date March 2005. For some reason we did not file the I485. Now I am looking for the new employer who can file my labor and I140 in EB2 category while I am still working for the current employer. Once the EB2 I140 is approved, I can switch to my new employer. My question is as follows
    1. If for some reason, the porting was not done from eb3 to eb2 and new I140 is approved, will I be able to file I485 with the new employer?

    Can some one help me out what i have to do in my specific case.

    I applied for AINP on Feb-2009.That time my martial status is single.I got married on April-2009.I got my file number last week.If i want to include my spouse on my AINP process what i have to do?Did anyone faced this kind of situation?

    Please help me.


    I applied in April and we had a baby after that. I called on the number on the form and they said once I get the file number, I need to again fill out the forms which need dependent information and send them over with additional documentation. You may just want to call them and re verify. I found the CSR very helpful and polite.

    IMHO, Father & Son "feels" better, while Solitary Fisherman would be the best technically if it were cropped tighter (moreso on the left and top, being careful on the latter to avoid centering him or getting him high in the frame). To me, the rest of the shots have too much distracting material in the background (including Solitary #2, though that one is not as bad as the others, and the distracting element could be "solved" in Photoshop if the contest allows this ;)).

    Edit to add more thoughts: If anyone tells you that you suck, keep practicing and prove them wrong (they're probably jealous anyway because they're even worse). I still have trouble with distracting backgrounds - that's probably the most frequent reason I send frames to the circular file, after technical errors (exposure, focus, etc.). Practice, not hundreds or thousands of frames per day of thoughtless practice, but concentrated, thoughtful practice, engaging the mind and paying attention to what's in the viewfinder (and what isn't, and what shouldn't be), is the way to improve. :)

    My colleague paid $340 recently for renewal of EAD. He was July 2007 AOS filer.


    But I read this on http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=73ddd59cb7a5d010VgnVCM10000048f3d6a1RCR D

    "If you are filing for an extension of your Employment Authorization and your Form I-485, Application for Permanent Residence, was filed before July 30, 2007, then you must pay the $340 filing fee."

    So I suggest check with Lawyer.

    When were your applications filed? If it was before July 30, your I-485 could be filed at either Nebraska or Texas.

    Is it not after July 30?...that you could submit to either to Nebraska or Texas?

    I just post a msg saying we can file 485 if 140 is pending. But after reading some other posts, I realize that we can file it only if PD from the labor we are using is current. If we want to use PD from an old employers application, we need to have date ported on new i140 application before 485 can be applied.

    Is that true? In that case, 140 from my new employer is not approved yet.....so i cud not be able to apply for 485 here :-(

    Hi,
    I am from India. My previous attorney paper filed my I-140 in Nov. 2006. My new attorney filed I-485 in July 2007. My new attorney has received only the copy of I-140 application and receipt from the previous attorney.
    In late 2008, with the help of a congressman, my new attorney was able to figure out that USCIS has lost my original I-140 application (filed at Nebraska center) and USCIS has issued the same I-140 receipt no. to somebody else. Then USCIS auto-created a new I-140 and gave me SRC receipt no. with filing date as Jan 2008 and as electronically filed by my previous attorney.

    The new I-140 (SRC one) got approved in March 2009.

    Got RFE in August 2009 for my I-485 application asking for the approval notice of my original I-140. My new attorney responded with all the history and the new I-140 approval notice.
    Now I have received NOID for my I-485 threatening that if I don't submit the original receipt for the original I-140 then USCIS will deny my application. The USCIS is saying that auto-created I-140 has been filed more than 6 months later than filing I-485 case and can't be the base for filing I-485.
    The previous attorney has not provided the original receipt of the original I-140 application and is not reachable via any means (doesn't respond to e-mail or phone calls. Office remains locked whenever I tried to visit him). So getting the original receipt from him is almost impossible. USCIS is not happy with the copy of the receipt.
    Right now I don't have any proof (other than copy of the receipt of the original I-140 filing) to support that my I-140 was filed before I-485 filing.
    What should I do in this case? Any suggestion will be appreciated.

    yes, now we should all start calling uscis - atleast 10 times a day, open SRs, take 4-5 infopass appointments and maybe consider going to NSC or TSC in person to see if we can talk to the IO (or have a cup of tea with the IO) to expedite our respective cases.

    Who knows, if we do such things, we mite get our GCs faster than ppl already waiting ahead of us in the queue. :)

    I wud also take this oppurtunity to invite more EB3 ppl to convert to EB2 now....this way, u cud get a EB-2 PD back in time, when u were not qualified for EB2. And with all desi body shops, getting this done is a piece of cake, i would assume.

    Now boot me from the forums or give me all those red marks - i don't care. I wrote what was on my mind.

    Because the PDs are valid for the whole month I guess the date of filing should not matter it as long as it is before 30th June, I think.

    Hi All,
    I am on H1 (beginning of my second 3 yr term on H1), EB2labor pending ( two US MS degrees in engineering) & I would like to apply for a full time MBA to NYU .
    I would like to know if this is possible while being on H1. I know i can apply for a part time program.. but I would like to pursue a full time MBA or would I have to convert to a F1 ?..
    How about pursuing a full time MBA with EAD ( 485 PENDING)
    I would like to plan for a future scenario, as I would definitely want to pursue a MBA. Can you guys shed some light on this topic ?
