    As per July bulletin it looks like it will be current till Aug 31st...

    Hi,
    I have applied for my PERM labor and have not got any approval on that...I am checking to see if the Concurrent Filing of I-140 and I-485 is still available....???

    and also how many days or months does anyone think this PD will remain current..???

    Any suggestions will be appreciated...!!!

    Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.

    Last time I have showed one copy. They have asked for the second one which I did not take with me.

    The POE officer said that USCIS normally sends two copies one for the applicant and one for POE to retain as a proof of entry.

    They also said it is ok if we don't take the second one with us.

    They just took a copy of the first one and kept it for their records.

    Why would anyone want to go 2 steps behind when already on last stage of getting GC. Won't it be like giving an 10th class exam again when you are already graduate and about to receive an job ?

    Can PERM Labor be filed by an employer for a dependent who is in AOS?
    Dependent has EAD and working.

    Hi, I would like to change job but my credit history is so bad. credit score is in recovery stage. I was unable to pay credit card debt and worked with settlement company and settled all the cards..I paid every thing as of last month. But there were delequencies still appearing on my report..

    I am working for a decent company, but i would like to change the job due to uncertainity and very less compensation..

    It is very very urgent. Can some one suggest if there will be any issues that matters job switching. In general, will the companies pull credit reports and deny jobs based on credits...Will the credit history matters.. I did not had any foreclosures or bankruptsy.

    few days ago, I tried to extend H4 visa for my spouse but I heard through one of the lawyer in the firm that once H4 visa holder used EAD, H4 becames invalid unless you enter again in POE using H4, we cant apply for H4 extension as the current status is AOS. But we are still exploring it.

    I checked in H4 extension form I-539, they ask:
    1. current immigration status?
    2. whether you want to extend current status or change of status?

    But my spouse is working so if we say change status to H4 from AOS then not sure whether she can use immediately EAD to work? I opened a thread regarding this.

    Anybody experienced the same issue as above? Thanks.

    Once your spouse started to use EAD (Work), spouse is no longer on H4 status and H4 status expires. You can reapply for H4 as long as primary applicant is still on H1. Once H4 is applied and i-797 issued, spouse had to go for stamping for h4 and reenter to be again in H4 status.

    I am planning to sponsor for my in-laws and have a list of all the required documents, but I have a question about the financial/property documents they need to to take. The reason being, my father-in-law is retired and since then they have been living based on he pension and rental from some of the properties they own and have not filed tax returns.

    Will getting the property evaluation and showing cash balance sufficient OR do I need them to take any additional documentation. Their source of income is just the pension and rental properties. Since most of the transactions happen in CASH in India, they don't have bank statements or records to support the rental property, except for the original property documents associated with the rental properties.

    Since I am the sponsor, I have got all the required docs from my side both immigration and financial docs properly. I believe, my in-laws also need to get the property and other docs handy to prove the ties back to the home country.

Their methodology "measures the extent to which state economies are knowledge-based, globalized, entrepreneurial, IT-driven and innovation-based � in other words, to what degree state economies� structures and operations match the ideal structure of the New Economy." The winners? Massachusetts, Washington, Maryland, New Jersey and Connecticut. The laggards? Mississippi, West Virginia, Arkansas, Alabama and Wyoming.

    I never really know what to make of reports like this, but one of the metrics is "immigration of knowledge workers," which really isn't under the control of individual states. Visa quotas are set by the federal government. But why? There are a lot of places where a national solution really is best, but that seems particularly untrue in immigration. Detroit, for instance, has a lot of empty houses, a lot of shuttered factories, and a lot of emigration. They could probably use a bunch of immigrants to occupy homes, buy things, and start businesses. Similarly, California has had a pretty good experience with letting highly skilled immigrants start tech firms in the Northern part of the state.     There are obvious difficulties with having a California visa that doesn't work in Oregon. But we have limited visas now -- think student visas, or temporary agricultural workers -- and we seem to get by all right.     I am on H1B with a NJ consulting company since 10/2004.
    I am working with a client in Los Angeles, CA.

    My H1b Visa expired in 05/2010 and I just got my 3-year extention.
    In my petition I gave details of current client.

    Today an Agent came from USCIS for an onsite(client-side) visit and verification.
    The agent asked me various question mostly related to my petition
    I was told my name was picked up randomly.
    It is part of USCIS Site visit and verification Program

    Anyone has a similar experience?
